Terms of Use

These Terms of Use ("Terms") govern your access to and use of VibeSifter.com and related VibeSifter features, content, and services (collectively, the "Service"). The Service is operated by VibeSifter ("VibeSifter," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What VibeSifter Is

VibeSifter is an independent vehicle-discovery tool. It helps users explore and organize third-party vehicle listings, including listings from eBay Motors, using VibeSifter's search, filtering, saving, sorting, and resonance-matching features. VibeSifter is not a vehicle dealer, seller, broker, auction house, inspection service, appraisal service, lender, insurer, title service, or party to any transaction between you and a third party.

2. eBay and Other Third Parties

VibeSifter is independent from eBay. eBay, eBay Motors, eBay logos, seller content, listing content, trademarks, and other third-party names or materials are owned by their respective owners. Reference to eBay or another third party does not mean that the third party sponsors, endorses, controls, or guarantees VibeSifter unless expressly stated by that third party.

When you follow a link from VibeSifter to eBay or another third-party service, your use of that service is governed by the third party's own terms, privacy policy, transaction rules, seller policies, and other requirements.

3. Affiliate Relationship

VibeSifter participates in the eBay Partner Network and may participate in other affiliate programs. When you click certain outbound links and make a qualifying purchase, VibeSifter may receive compensation. Affiliate compensation does not make VibeSifter the seller and does not create a warranty, inspection obligation, fiduciary relationship, agency relationship, or other responsibility for the underlying item or transaction.

4. Listing Data, Prices, Availability, and Accuracy

Third-party listings can change quickly. Vehicle availability, price, mileage, title status, location, options, condition, photographs, seller statements, shipping terms, fees, taxes, and other listing information may be incomplete, delayed, inaccurate, stale, or changed after VibeSifter displays it. A vehicle shown on VibeSifter may already be sold, removed, revised, or otherwise unavailable.

VibeSifter does not independently verify every listing or seller. Before acting on any result, you must review the current source listing and independently verify all information that matters to your decision.

5. No Vehicle Inspection, Appraisal, or Professional Advice

VibeSifter results, rankings, saved items, examples, labels, descriptions, resonance scores, or other output are discovery aids, not professional advice or factual certification. VibeSifter does not certify condition, authenticity, safety, roadworthiness, legal compliance, title status, value, collectability, investment potential, repair cost, insurance eligibility, or suitability for a particular use.

For any potential vehicle purchase, use appropriate independent due diligence, which may include a pre-purchase inspection, vehicle-history review, title/lien verification, recall research, seller verification, and professional mechanical, legal, tax, insurance, or financial advice as appropriate.

6. Your Use of the Service

Subject to these Terms, VibeSifter grants you a limited, revocable, non-exclusive, non-transferable license to use the Service for lawful personal or internal business purposes. You are responsible for your activity and for complying with applicable law and third-party terms.

7. Prohibited Uses

You may not use the Service to: (a) interfere with, overload, disable, damage, or disrupt the Service or its infrastructure; (b) bypass access controls, rate limits, usage limits, or security measures; (c) use bots, scripts, scrapers, crawlers, automated agents, or similar methods in a manner that burdens the Service, circumvents controls, or violates applicable third-party terms; (d) probe or attempt to obtain unauthorized access to systems or data; (e) introduce malware or harmful code; (f) impersonate VibeSifter, eBay, a seller, or another person; (g) use VibeSifter branding or content in a misleading manner; (h) use the Service for unlawful, fraudulent, deceptive, or infringing activity; or (i) copy, reverse engineer, decompile, or attempt to derive non-public source code or proprietary methods except to the limited extent such restriction is prohibited by applicable law.

8. Intellectual Property

The VibeSifter name, branding, site design, original text, software, interfaces, selection and arrangement of content, and proprietary discovery/ranking methods are owned by or licensed to VibeSifter and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

Third-party listing content, photographs, trademarks, product names, and other third-party materials remain the property of their respective owners and may be subject to separate terms and licenses.

9. Saved Items, Exports, and User-Controlled Data

The Service may allow you to save searches or listings and export information. Saved or exported material may depend on your browser, device, current listing availability, or third-party source data. You are responsible for keeping any export or record you need. VibeSifter does not promise that saved items, search states, rankings, or exports will remain available indefinitely.

10. Service Changes and Availability

We may add, remove, suspend, limit, or change features, data sources, filters, ranking methods, interfaces, or the Service itself at any time. We do not guarantee uninterrupted or error-free operation, continued access to a particular third-party data source, or continued availability of any listing.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." VIBESIFTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND RELIABILITY. WE DO NOT WARRANT THAT RESULTS WILL MATCH YOUR EXPECTATIONS OR THAT THIRD-PARTY LISTINGS OR TRANSACTIONS WILL BE ACCURATE, SAFE, AUTHENTIC, LEGAL, OR SATISFACTORY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESIFTER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, LOSS OF USE, VEHICLE REPAIR COSTS, TRANSACTION LOSSES, OR LOSSES ARISING FROM A THIRD-PARTY LISTING, SELLER, PURCHASE, SALE, SHIPPING ARRANGEMENT, TITLE ISSUE, MISREPRESENTATION, FRAUD, OR VEHICLE CONDITION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESIFTER'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO VIBESIFTER FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless VibeSifter and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from your unlawful misuse of the Service, your violation of these Terms, or your infringement of another person's rights.

14. Suspension or Termination

We may restrict or terminate access to the Service when reasonably necessary to protect the Service, users, third parties, legal compliance, or our rights. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, limitation-of-liability, indemnification, and dispute provisions.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Unless applicable law requires otherwise, exclusive venue for disputes arising from these Terms or the Service will be the state and federal courts located in Buncombe County, North Carolina.

Nothing in these Terms limits any non-waivable consumer rights that apply to you under law.

16. Changes to These Terms

We may update these Terms from time to time. The "Effective date" above indicates when the current version took effect. Continued use of the Service after an updated version becomes effective constitutes acceptance to the extent permitted by law. Material changes may be communicated through the Service or another reasonable method.

17. Severability; No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
